Know Your Disclosure Duties in California

California has some of the most comprehensive real estate disclosure requirements in the country. Understanding your obligations as a seller is essential to avoiding legal liability and building buyer trust. Failing to disclose known issues can expose you to lawsuits long after closing, making transparency not just a legal duty but a smart selling strategy.

Here are the top things you must disclose:

Natural Hazard Disclosure (NHD) Report: A state-mandated report disclosing whether the property is located in hazard zones such as earthquake fault zones, flood zones, fire hazard severity zones, or wildfire risk areas. This is a legal requirement and failure to provide it can give buyers grounds to cancel the contract.
Mello-Roos & Special Assessments: Sellers must disclose any special taxes levied on the property through Community Facilities Districts (CFDs), which fund local infrastructure like schools, roads, and parks.
HOA Document Package: If the property is part of a homeowners association, sellers must provide a full package of governing documents including bylaws, financial statements, meeting minutes, and CC&Rs.
Transfer Disclosure Statement (TDS): California law requires most sellers to complete a Transfer Disclosure Statement, which covers the known condition of the property including appliances, structural components, and any known defects.
Seller Property Questionnaire (SPQ): In addition to the TDS, sellers must complete an SPQ disclosing more detailed information about the property's history, including past repairs, insurance claims, neighbor disputes, and environmental concerns.
The Role of Escrow: California requires a neutral third-party escrow company to manage the transaction, holding funds and documents until all conditions of the sale are met.
