Tennessee sellers must disclose the known condition of their property before going to market. Being upfront with buyers reduces your legal exposure after closing and keeps transactions on track from contract to close.

Here are the key things you must disclose:

Tennessee Residential Property Condition Disclosure: Sellers must complete this state-mandated form in good faith, disclosing known defects in the property's structural components, systems, and any environmental hazards.
Lead-Based Paint (Pre-1978 Homes): Federal law requires sellers to disclose known lead hazards, provide an EPA-approved pamphlet, and allow buyers up to 10 days for a lead inspection.
HOA or PUD Documents: Sellers must provide governing documents, bylaws, and the master deed for any HOA or planned unit development. Request these early as they can take time to obtain.
Wood-Destroying Insect (WDI) Report: Commonly requested by buyers and lenders in Tennessee due to the Southern climate. Being proactive with this report can prevent delays close to closing.
Known Material Defects: Sellers cannot conceal or misrepresent known issues affecting the value or safety of the property, including structural problems, water intrusion, mold, or pest damage.
