Know Your Disclosure Duties in North Carolina

North Carolina sellers have specific disclosure obligations that must be met before going to market. Being transparent about your property's condition is not only required by law, it also builds buyer trust and significantly reduces your risk of legal disputes after closing. Nearly two thirds of real estate lawsuits stem from disclosure issues, making this one of the most important steps in the process.

Residential Property and Owners' Association Disclosure Statement (RPOADS): North Carolina's state-mandated disclosure form covering the known condition of the property, including the roof, HVAC, plumbing, and structural issues. This must be provided to the buyer before they make an offer.
Mineral, Oil and Gas Rights Disclosure (MOG): Sellers must disclose whether mineral, oil, or gas rights have been severed and sold to a third party. This determines whether someone else holds the right to access your land for extraction purposes.
Due Diligence Fee: Unique to North Carolina, the due diligence fee is a non-refundable payment made by the buyer to the seller at contract signing. In exchange, the seller takes the home off the market while the buyer completes inspections, secures financing, and performs their research.
Lead-Based Paint (Pre-1978 Homes): Federal law requires sellers of homes built before 1978 to disclose known lead hazards, provide an EPA-approved pamphlet, and allow buyers up to 10 days for a lead inspection.
Known Material Defects: Sellers are prohibited from concealing or misrepresenting any known defects that could affect the value or safety of the property, including structural problems, water intrusion, pest issues, or mold.
HOA Membership: If the property is part of a homeowners association, sellers must disclose this along with relevant fees, rules, and governing documents so buyers understand their obligations before making an offer.
