Know Your Disclosure Duties in South Carolina

South Carolina sellers must disclose the known condition of their property before going to market. Being upfront protects you from legal disputes after closing and keeps deals on track. Note that South Carolina is an attorney-closing state, meaning a licensed real estate attorney must oversee the final closing process.

Here are the most important items you must disclose:

SC Residential Property Condition Disclosure Statement: State-mandated form required by the SC Real Estate Commission where sellers disclose the known condition of the property, including the roof, plumbing, foundation, and environmental hazards. Must be provided to the buyer before a contract is signed.
CL-100 Wood Infestation Report: A termite and wood-destroying organism inspection required for nearly all South Carolina real estate transactions, especially when the buyer is obtaining a mortgage. This must be completed close to the closing date.
Lead-Based Paint (Pre-1978 Homes): Federal law requires sellers of homes built before 1978 to disclose known lead hazards, provide an EPA-approved pamphlet, and allow buyers up to 10 days for a lead inspection.
HOA or Condo Documents: If the property is part of an HOA or condo association, sellers must provide buyers with the governing documents, bylaws, and any applicable fees. Request these early as they can take time to obtain.
Known Material Defects: Sellers are prohibited from concealing or misrepresenting any known defects that could impact the value or safety of the property, including structural issues, water damage, mold, or pest infestations.
Attorney Closing Requirement: South Carolina law requires a licensed real estate attorney to oversee the closing process. Sellers should engage an attorney early to ensure all documents are prepared correctly and the transaction closes without issues.
