Know Your Disclosure Duties in Texas

Selling a home in Texas involves specific legal disclosure obligations that every seller should understand before going to market. Texas law requires sellers to be upfront about the condition of their property, and failing to do so can expose you to serious legal and financial consequences after closing. Being transparent builds buyer trust and helps keep your deal on track.

Here are the most important items you must disclose:

Seller's Disclosure Notice: Texas law requires most sellers to complete a Seller's Disclosure Notice covering the known condition of the property, including the roof, foundation, plumbing, electrical, HVAC, and any known defects or past repair
Property Tax Disclosure: Texas has no state income tax, but property taxes are among the highest in the nation. Sellers must provide buyers with current tax information, as it significantly impacts total cost of ownership.
Homestead Exemption: Homestead exemptions do not transfer automatically to new owners. Buyers must apply for their own exemption after purchase, and their tax obligation will be based on the updated sale price.
Lead-Based Paint (Pre-1978 Homes): Federal law requires sellers of homes built before 1978 to disclose known lead-based paint hazards, provide an EPA-approved pamphlet, and allow buyers up to 10 days for a lead inspection.
HOA Membership: If the property is part of an HOA, sellers must disclose this along with relevant fees, governing documents, and rules. Texas law also requires sellers to provide buyers with a resale certificate from the HOA.
Known Material Defects: Sellers are prohibited from concealing or misrepresenting known problems with the property, including structural issues, drainage problems, pest infestations, mold, or any condition affecting value or safety.
